I think he was no longer in this world, he was in the heavenly kingdom and if he had spoken to Herod, he would not have understood Him. Also that his mission on earth was not to be delayed by the thinking of mortals who could only see earthly things without seeing the spiritual realm of God's purpose for mankind.

If neither Herod nor Pilate found anything worthy of death to convict Jesus of then why was he sentenced to death? To fulfill what had brought him to earth to save us from sin
